Platform terms (v1.6)

1. How these terms work

  1. ViaClara's Terms of Use are made up of three documents: these Platform Terms, which apply to all users; the Parent Terms, which apply to individuals using ViaClara to search for allied health support (Parent Users); and the Practitioner Terms, which apply to allied health practitioners listing on ViaClara (Practitioner Users).
  2. If you are a Parent User, these Platform Terms and the Parent Terms both apply to you. If you are a Practitioner User, these Platform Terms and the Practitioner Terms both apply to you. Together, the applicable documents form your complete agreement with MAME CREATIVE PTY LTD.
  3. If there is any inconsistency between these Platform Terms and the Parent Terms or Practitioner Terms, the Parent Terms or Practitioner Terms prevail in respect of the matters they specifically address.

2. About the website

  1. Welcome to www.viaclara.com.au (Website). The Website allows you to access and use ViaClara (Services).
  2. The Website is operated by MAME CREATIVE PTY LTD, ABN 89 691 093 802 (we, us, our). Access to and use of the Website, or any of its associated products or Services, is provided by MAME CREATIVE PTY LTD. Please read these Terms carefully. By using, browsing and/or reading the Website, this signifies that you have read, understood and agree to be bound by the applicable Terms. If you do not agree, you must cease usage of the Website, or any of the Services, immediately.
  3. MAME CREATIVE PTY LTD reserves the right to review and change any of the Terms by updating this page at its sole discretion. When MAME CREATIVE PTY LTD updates the Terms, it will use reasonable endeavours to provide you with notice of updates. Any changes take immediate effect from the date of their publication. We recommend you keep a copy of the Terms for your records.

3. Acceptance of the terms

  1. You accept these Platform Terms, and the Parent Terms or Practitioner Terms applicable to you, by remaining on the Website. Where the option is available in the user interface, you may also accept the Terms by clicking to accept or agree.
  2. Where you create an account on the Website - whether as a Parent User or a Practitioner User - your acceptance of these Platform Terms, and of the Parent Terms or Practitioner Terms applicable to you, is evidenced by the affirmative action you take at account creation (a checkbox confirming you have read and agree to the applicable documents), rather than by clause 3(a) alone. If you are a Practitioner User, your acceptance of the Practitioner Terms specifically is evidenced in the same way at the point you complete your practitioner registration, which may occur after account creation. Clause 3(a) continues to apply, unaffected by this clause, to any use of the Website that does not involve creating an account - for example, browsing the Website or viewing a practitioner's public profile without registering.

4. About the service

  1. ViaClara is a web-based directory and connection platform that connects individuals seeking allied healthcare services with qualified allied healthcare professionals who commit to neuroaffirming practices. ViaClara is a directory service only. We do not provide healthcare services and do not endorse or recommend any specific practitioner.

5. Acceptable use of the service

  1. The Service, its related features, and Website must only be used lawfully. MAME CREATIVE PTY LTD reserves the right to suspend, cancel, or otherwise deny access to users and accounts who use the service:
    1. To engage in any act that would disrupt the access, availability, and security of ViaClara or other MAME CREATIVE PTY LTD services, including but not limited to: tampering with, reverse-engineering, or hacking our servers; modifying, disabling, or compromising performance; overwhelming our infrastructure; or compromising system integrity, including unauthorised probing, scanning, or vulnerability testing;
    2. For any illegal purpose, or to violate any laws, including data, privacy, and export control laws;
    3. To stalk, harass, or threaten users or any member of the public;
    4. To misrepresent or defraud any user or member of the public through phishing, spoofing, impersonation, or false implication of sponsorship or association with MAME CREATIVE PTY LTD or a third party;
    5. To access or search any part of the Service other than our publicly supported interface; or
    6. To post, upload, share, or otherwise circulate content in violation of ViaClara's Platform Content Policy, available at www.viaclara.com.au/platform-content-policy.

6. Security and data privacy

  1. MAME CREATIVE PTY LTD takes your privacy seriously. Information provided through your use of the Website and/or Services is subject to MAME CREATIVE PTY LTD's Privacy Policy. The Privacy Policy addresses MAME CREATIVE PTY LTD's processes, policies, and obligations in respect of security and data breaches.

7. Data use

  1. MAME CREATIVE PTY LTD collects, stores, and processes your data on ViaClara. The data is used to provide the Services and to facilitate MAME CREATIVE PTY LTD's business operations. The Privacy Policy outlines how your data is collected, stored, and processed, including data retention and deletion practices.
  2. Where you have opted in to receive marketing communications from MAME CREATIVE PTY LTD (such as our newsletter), we will only send them in accordance with your consent and the Spam Act 2003 (Cth). You can withdraw this consent at any time via the unsubscribe link in any marketing message, or via your account settings, without affecting your ability to use the Services. See the Privacy Policy, Section 4.3, for further detail, and Practitioner Terms clause 3(m) for how this preference carries forward for Practitioner Users.
  1. The Website, the Services, and all related products of MAME CREATIVE PTY LTD are subject to copyright. The material on the Website is protected by copyright under the laws of Australia and through international treaties. Unless otherwise indicated, all rights are owned or controlled by MAME CREATIVE PTY LTD or its contributors.
  2. All trademarks, service marks and trade names are owned, registered and/or licensed by MAME CREATIVE PTY LTD, who grants to you a worldwide, non-exclusive, royalty-free, revocable licence whilst you are a User to: use the Website pursuant to the Terms; copy and store the Website and its material in your device's cache memory; and print pages from the Website for personal, non-commercial use.
  3. MAME CREATIVE PTY LTD does not grant you any other rights in relation to the Website or the Services. All other rights are expressly reserved by MAME CREATIVE PTY LTD.
  4. MAME CREATIVE PTY LTD retains all rights, title and interest in and to the Website and all related Services. Nothing you do on or in relation to the Website transfers any business name, trade mark, patent, registered design, or copyright (or any right to use or exploit any of the foregoing) to you.
  5. You may not, without the prior written permission of MAME CREATIVE PTY LTD and the permission of any other relevant rights owners, broadcast, republish, upload to a third party, transmit, post, distribute, show or play in public, adapt or change in any way the Services or third party Services for any purpose, unless otherwise provided by these Terms.

9. General disclaimer

  1. Nothing in the Terms limits or excludes any guarantees, warranties, representations or conditions implied or imposed by law, including the Australian Consumer Law (or any liability under them) which by law may not be limited or excluded.
  2. Subject to this clause, and to the extent permitted by law: all terms, guarantees, warranties, representations or conditions which are not expressly stated in the Terms are excluded; and MAME CREATIVE PTY LTD will not be liable for any special, indirect or consequential loss or damage (unless reasonably foreseeable resulting from our failure to meet an applicable Consumer Guarantee), loss of profit or opportunity, or damage to goodwill arising out of or in connection with the Services or these Terms, whether at common law, under contract, tort (including negligence), in equity, pursuant to statute or otherwise.
  3. Use of the Website and the Services is at your own risk. Everything on the Website and the Services is provided to you “as is” and “as available” without warranty or condition of any kind. This includes (but is not restricted to) loss or damage you might suffer as a result of: failure of performance, error, omission, interruption, deletion, defect, delay, computer virus, loss of data, communication line failure, unlawful third party conduct, or theft, destruction, alteration or unauthorised access to records; the accuracy, suitability or currency of any information on the Website; costs incurred as a result of you using the Website or the Services; and the operation of links provided for your convenience.

10. Limitation of liability

  1. MAME CREATIVE PTY LTD's total liability arising out of or in connection with the Services or these Terms, however arising, will not exceed the resupply of the Services to you.
  2. You expressly understand and agree that MAME CREATIVE PTY LTD, its affiliates, employees, agents, contributors and licensors shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages which may be incurred by you, however caused and under any theory of liability. This includes, but is not limited to, any loss of profit, loss of goodwill or business reputation, and any other intangible loss.

11. Indemnity

  1. You agree to indemnify MAME CREATIVE PTY LTD, its affiliates, employees, agents, contributors, third party content providers and licensors from and against: all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) arising out of or in connection with your content; any direct or indirect consequences of you accessing, using or transacting on the Website; and any breach of the Terms.

12. Dispute resolution

  1. Compulsory: If a dispute arises out of or relates to the Terms, either party may not commence Tribunal or Court proceedings in relation to the dispute, unless the following clauses have been complied with (except where urgent interlocutory relief is sought).
  2. Notice: A party claiming a dispute (Dispute) has arisen must give written notice to the other party detailing the nature of the dispute, the desired outcome, and the action required to settle it.
  3. Resolution: On receipt of that notice, the parties must, within 28 days, endeavour in good faith to resolve the Dispute by negotiation; if unresolved after 28 days, the parties must agree on a mediator or request one be appointed by the Resolution Institute. The parties are equally liable for mediator fees and venue costs and must each pay their own costs of mediation. Mediation will be held in Sydney, Australia.
  4. Confidential: All communications concerning negotiations under this clause are confidential and, to the extent possible, treated as “without prejudice” for the purposes of applicable laws of evidence.
  5. Termination of Mediation: If 2 months have elapsed after the start of mediation without resolution, either party may ask the mediator to terminate the mediation, and the mediator must do so.

13. Venue and jurisdiction

  1. The Services are intended to be viewed by residents of Australia. You agree that the exclusive venue for resolving any dispute shall be in the courts of New South Wales.

14. Governing law

  1. The Terms are governed by the laws of New South Wales. Any dispute, controversy, proceeding or claim of whatever nature arising out of or relating to the Terms shall be governed, interpreted and construed by, under and pursuant to the laws of New South Wales, Australia, notwithstanding mandatory rules. The Terms are binding to the benefit of the parties and their successors and assigns.

15. Platform content policy

  1. All content posted, uploaded, or published on ViaClara - by Parent Users or Practitioner Users - must comply with the Platform Content Policy, available at www.viaclara.com.au/platform-content-policy. The Platform Content Policy forms part of these Terms.
  2. MAME CREATIVE PTY LTD reserves the right to remove or require amendment of content in response to breaches of the Platform Content Policy, without notice and without liability. Suspension, restriction, or removal of a user's account or listing in response to a breach is governed by clause 3(c)–(d) of the Parent Terms or clause 6(e)–(f) of the Practitioner Terms, as applicable, including the notice and review mechanisms set out there.

16. Severance

  1. If any part of these Terms is found to be void or unenforceable by a Court of competent jurisdiction, that part shall be severed and the rest of the Terms shall remain in force.

Practitioner terms (v2.13)

1. How these terms apply

  1. These Practitioner Terms apply to you if you register for or use a Practitioner Account on ViaClara, on any tier. They apply in addition to ViaClara's Platform Terms, available at www.viaclara.com.au/terms#platform-terms. By using ViaClara as a Practitioner User, you accept both documents.
  2. If there is any inconsistency between these Practitioner Terms and the Platform Terms, these Practitioner Terms prevail in respect of the matters they specifically address.

2. Practitioner account tiers

  1. Practitioner Accounts are available on the following tiers:
    1. Pay As You Go - a basic practitioner profile with no recurring subscription fee, with Help Wanted Ad responses charged separately on a per-response basis;
    2. Pro Plan - a paid monthly subscription fee covering a full practitioner profile and the additional features described at www.viaclara.com.au/pricing, with Help Wanted Ad responses charged separately on a per-response basis; and
    3. Business Builder Plan - a paid monthly subscription fee covering all platform features, including unlimited Help Wanted Ad responses.
  2. Current plan inclusions and pricing are available at www.viaclara.com.au/pricing. References in these Terms to a “Subscription” or “Subscription Fee” refer to the Pro Plan and Business Builder Plan monthly fees; the Pay As You Go tier does not involve a Subscription Fee but remains subject to per-response charges and other fees as set out at www.viaclara.com.au/pricing.
  3. MAME CREATIVE PTY LTD may change the account tiers offered, or the features included in each tier, from time to time. Where this occurs, you will be informed and, if the change is material, your continued use of a paid tier will be subject to reasonable notice as set out in clause 4(d).

3. Registration

  1. To access the Services, you will be required to register for a Practitioner Account through the Website (Account). On any paid tier, you may also be required to pay the applicable fee for your selected tier (Subscription Fee).
  2. It is your responsibility to ensure the tier you select is suitable for your use.
  3. As part of registration, or as part of your continued use of the Services, you may be required to provide personal information, including but not limited to your name, email address, phone number, professional registration details, payment and billing information, and service preferences. Some of this information - specifically your ABN and professional registration/membership number - will be displayed publicly on your profile as described in clause 3(g). You warrant that any information you provide will always be accurate, correct and up to date.
  4. Once you have completed registration, you will be a registered user of the Website and agree to be bound by these Terms (User). If you hold a paid Subscription, you will be considered a member (Member) and will be granted access to the Services on your selected tier from the time you complete registration until your Subscription Period expires (Subscription Period).
  5. You may not use the Services if: you are not of legal age to form a binding contract with MAME CREATIVE PTY LTD; you are not appropriately registered or qualified to provide the allied health services described in your profile; or you are currently suspended, deregistered, or subject to a banning order by AHPRA or an equivalent professional body.
  6. Registration is subject to MAME CREATIVE PTY LTD's review and approval. As part of this review, you will be asked to provide a registration or membership number with the body relevant to your profession, where one exists. The verification check available, and the confidence level associated with that check, varies by profession, as follows:
    1. Tier 1 - Occupational Therapist, Psychologist, Psychiatrist, Paediatrician, Physiotherapist. We check your AHPRA registration number against the public AHPRA register. This is the highest-confidence check available on the platform, as the AHPRA register is independently maintained and updated in real time by the relevant National Board.
    2. Tier 2 - Speech Pathologist. We check your membership or certification number against Speech Pathology Australia's “Find a CPSP” public search. Speech Pathology Australia actively certifies and audits practitioners listed on this register.
    3. Tier 2 - Counsellor. We check your registration number against the Australian Register of Counsellors and Psychotherapists (ARCAP), a unified register maintained jointly by PACFA and the ACA. ARCAP actively certifies practitioners listed on this register.
    4. Tier 2 - Art Therapist. We check your membership number against ANZACATA's “Find a Therapist” public directory. ANZACATA actively certifies practitioners listed on this directory.
    5. Tier 3 - Dietitian. We check your Accredited Practising Dietitian (APD) number against the Dietitians Australia directory. Dietitians Australia does not independently verify the accuracy of information contained in its directory; MAME CREATIVE PTY LTD relies on the directory as provided.
    6. Tier 3 - Music Therapist. We check your registration number against the Australian Music Therapy Association (AMTA) public directory. AMTA has stated that this directory may be incomplete. Where a registration cannot be confirmed via the directory, MAME CREATIVE PTY LTD may contact AMTA directly to confirm your current registration status before approving or maintaining your Account.
    7. Tier 4 - Nutritionist. No single Australian registration body exists for this practice area, and the title “Nutritionist” is not a restricted or protected title under Australian law. You may optionally disclose a relevant qualification or association membership. Any such disclosure is recorded as provided by you and is not independently verified by MAME CREATIVE PTY LTD. A registration number is not required for this profession, as no register exists against which one could be checked.
    8. Tier 4 - Equine-assisted Therapist. No single Australian registration body exists for equine-assisted therapy directed at children. The Equine Therapies Association of Australia (ETAA) is not a relevant body for this profession - it certifies practitioners of equine bodywork performed on horses, not equine-assisted therapy provided to children - and MAME CREATIVE PTY LTD does not check against, or reference, ETAA for this purpose.
      1. If you hold an underlying allied health or mental health registration (such as AHPRA registration, or ARCAP registration if you are also a registered Counsellor), you must disclose it, and MAME CREATIVE PTY LTD will check that registration against the relevant public register under whichever of sub-clauses (i)–(iv) applies to that registration type. Where you hold such an underlying registration, the confidence level and public disclosure treatment described in clause 3(g) are determined by that underlying registration, not by your Equine-assisted Therapist profession classification.
      2. A registration number is not required for this profession where no underlying registration under sub-clause (A) is held. Any equine-assisted therapy training or certification you disclose (for example, course name, provider, or certifying body) is recorded as provided by you and is not independently verified by MAME CREATIVE PTY LTD.
    9. Registration Number Requirement. A registration or membership number is a mandatory condition of approval for Tiers 1–3 (sub-clauses (i)–(vi)). A registration number is optional for Tier 4 (sub-clauses (vii)–(viii)) except where clause 3(f)(viii)(A) applies, reflecting the absence of any register capable of validating one for these two professions.

    We may decline to approve your registration, or may request additional information before approval, where we have concerns about your eligibility or the accuracy of information provided. If your registration is not approved, you will be notified and may be given the opportunity to resubmit your application with corrected or additional information. You do not have a right to a Practitioner Account, and approval is at MAME CREATIVE PTY LTD's reasonable discretion.

  7. Public Display of Credentials. Your ABN and your professional registration or membership number (where applicable to your profession, per clause 3(f)) will be displayed on your public ViaClara profile, together with the name of the relevant register or association, so that Parent Users and members of the public can independently verify this information. By registering for a Practitioner Account, you consent to this display.
    1. Where the relevant register does not independently verify the accuracy of information it holds, or has stated that its records may be incomplete, ViaClara will display a notice to that effect alongside your credential, as follows:
      • Dietitians: “Dietitians Australia does not independently verify the accuracy of information in its directory.”
      • Music Therapists: “The AMTA directory may be incomplete. Contact AMTA directly to confirm current registration status.”
    2. Where no register exists for your profession (Nutritionist, Equine-assisted Therapist without an underlying AHPRA or ARCAP registration), any qualification, training, or certification information you choose to disclose will be displayed with a notice that it is self-reported and has not been independently verified.
    3. You must notify MAME CREATIVE PTY LTD promptly if any registration or membership number you have provided lapses, is suspended, is cancelled, or otherwise changes. Continuing to hold yourself out on ViaClara under a lapsed, suspended, or cancelled registration is a material breach of these Terms and clause 3(e).
  8. Working With Children Check. If your practice on ViaClara may involve unsupervised, in-person contact with children, you must hold a current Working With Children Check (or equivalent state/territory clearance) valid in each jurisdiction in which you practise, and must provide evidence of this on request. By registering for a Practitioner Account, you attest that you hold, and will maintain, such clearance for the duration of your registration. You must notify MAME CREATIVE PTY LTD promptly if your Working With Children Check or equivalent clearance lapses, is suspended, is cancelled, or otherwise ceases to be current. Continuing to practise on ViaClara without a current clearance is a material breach of these Terms. Evidence you provide under this clause, and the record of your attestation, are retained in accordance with our Data Retention Schedule - retention differs depending on the circumstances of your account's closure (see clause 6(e)–(f)).
  9. No Re-Registration After Removal. You must not register a new Practitioner Account if MAME CREATIVE PTY LTD has previously suspended, restricted, or removed a Practitioner Account held by you under clause 6(e), unless MAME CREATIVE PTY LTD has expressly permitted you to re-register. MAME CREATIVE PTY LTD may take reasonable steps to verify your identity at registration - including cross-checking the professional registration or membership number, ABN, or other identifying information you provide against records of previously suspended, restricted, or removed accounts - to detect and prevent registration in breach of this clause.
  10. Ongoing Registration Status. The verification described in clause 3(f) is performed at the time of your registration and approval. It is not automatically repeated on an ongoing basis. Your notification obligation at clause 3(f)(iii) (registration changes) and clause 3(h) (Working With Children Check) applies for the duration of your registration, regardless of whether MAME CREATIVE PTY LTD conducts any further check.
  11. MAME CREATIVE PTY LTD may, at its discretion, conduct periodic or spot checks of a practitioner's registration status against the relevant public register. Regardless of how MAME CREATIVE PTY LTD becomes aware that a practitioner's registration is not current - including via its own check, a report from a Parent User or another practitioner, or any other source - MAME CREATIVE PTY LTD may suspend, restrict, or remove the relevant Account under clause 6(e) at any time.
  12. Availability Status. Your ViaClara profile displays an availability status (for example, Available Now, Filling Soon, Waitlist, or Not Accepting New Clients), which you set and update yourself via your practitioner dashboard. This status, and the date it was last updated, are entirely self-reported by you. MAME CREATIVE PTY LTD does not verify, audit, or otherwise confirm that your displayed availability status is accurate or reflects your actual current capacity to accept new clients.
  13. You are solely responsible for keeping your availability status accurate, and for ensuring it does not misrepresent your actual capacity to accept new engagements. Simply not updating your status within the two-week period referred to below is not, by itself, a breach of these Terms - its main consequence is the staleness indicator described below, which is visible to Parent Users and may affect how they view your profile. Deliberately displaying an availability status you know to be false, however, is a material breach of these Terms and clause 3(e). More generally, if MAME CREATIVE PTY LTD becomes aware - including via a pattern of reports from Parent Users submitted through our contact page at www.viaclara.com.au/contact, or any other source - that your availability status does not reflect your actual availability, this may be considered under clause 6(e) (grounds for suspension, restriction, or removal), regardless of whether it amounts to a material breach.
  14. If you have not updated your availability status within the preceding two weeks, ViaClara displays that status to Parent Users with a visual indicator that it may be out of date, together with a prompt directing the parent to contact you directly to confirm your current availability. You will receive an email reminder, and an equivalent indicator on your own dashboard, once your status has gone two weeks without an update. This staleness indicator reflects only how recently you updated your status - it is not, and is not represented to Parent Users as, a check by MAME CREATIVE PTY LTD of whether your status is in fact accurate.
  15. Where a Parent User has favourited your profile, that parent receives an in-app notification whenever you update your availability status to a different value. Keep this in mind when updating your status.
  16. NDIS Provider Attestation. During registration, you may attest that you are a registered provider with the NDIS Quality and Safeguards Commission, by completing the following declaration: “I am an NDIS registered provider. By checking this box, you confirm that you are currently registered as a provider with the NDIS Quality and Safeguards Commission, and that you will update this status and notify ViaClara promptly if your registration lapses, is suspended, or is revoked. Being able to provide services to NDIS participants who are plan-managed or self-managed does not, on its own, make you a ‘registered’ provider.”
  17. This attestation is entirely optional and is not a condition of creating, maintaining, or being approved for a profile on the Platform. You may register, be approved, and offer services through ViaClara whether or not you make this attestation.
  18. The sole purpose of this attestation is to help parents identify practitioners who may meet their NDIS plan-management requirements. It does not constitute verification, endorsement, or guarantee by MAME CREATIVE PTY LTD of your NDIS registration status.
  19. You must notify MAME CREATIVE PTY LTD promptly, and update your profile, if your NDIS registration status changes - including if it lapses, is suspended, or is revoked. Displaying an NDIS-registered status on the Platform after it has ceased to be accurate, without promptly notifying MAME CREATIVE PTY LTD, is a breach of these Terms and, as a misrepresentation relied upon by Parent Users in choosing a practitioner, may constitute grounds for suspension, restriction, or removal of your listing or account under clause 6(e).
  20. MAME CREATIVE PTY LTD may request evidence of your NDIS registration status at its discretion and record notes of any evidence sighted for internal review. MAME CREATIVE PTY LTD does not independently verify NDIS registration status as a matter of course and relies on your attestation.
  21. Marketing Communications. If you opted in to ViaClara's marketing mailing list when you created your account, that preference carries forward to your Practitioner Account - you do not need to opt in again at registration. You can review or change your marketing preference at any time in your account settings. See the Privacy Policy, Section 4.3, and Platform Terms clause 7(b) for how your marketing preferences are used and how to withdraw your consent.

4. Payments

  1. The Subscription Fee and any other fees referred to in these Terms may be paid by all payment methods available on the Website, and may change from time to time.
  2. Payments made in the course of your use of ViaClara may be made using third-party applications and services not owned, operated, or otherwise controlled by MAME CREATIVE PTY LTD. You acknowledge and agree that MAME CREATIVE PTY LTD will not be liable for any losses or damage arising from the operations of third-party payment applications and services. You further warrant that you have read, understood and agree to be bound by the terms and conditions of any third-party payment service you use.
  3. You acknowledge and agree that where a request for payment is returned or denied, for whatever reason, by your financial institution or is unpaid by you for any other reason, you are liable for any costs, including banking fees and charges, associated with that payment.
  4. You agree and acknowledge that MAME CREATIVE PTY LTD can vary the Subscription Fee or any other fee referred to in these Terms (including Help Wanted Ad response fees and prepaid credit package pricing) at any time. Varied Subscription Fees will come into effect following the conclusion of the existing Subscription Period. Varied per-response or other non-subscription fees will come into effect no earlier than 14 days after notice is given. We will provide you with reasonable notice of any fee variation, and current fees are always available at www.viaclara.com.au/pricing.

5. Refund policy

  1. MAME CREATIVE PTY LTD offers refunds in accordance with the Australian Consumer Law and on the terms set out in these Terms. Any benefits set out in these Terms may apply in addition to consumer rights under the Australian Consumer Law.
  2. This clause 5 governs refunds in the circumstances set out below and does not apply to voluntary cancellation of a Subscription under clause 6 - see clause 6(b)–(d) for the position on cancellation. Subject to that, MAME CREATIVE PTY LTD will refund the Subscription Fee (Pro Plan and Business Builder Plan) in the following circumstances:
    1. MAME CREATIVE PTY LTD is unable to continue to provide the Services;
    2. the Services are materially different from those described at the time of purchase; or
    3. the manager of MAME CREATIVE PTY LTD makes a decision, at its absolute discretion, that it is reasonable to do so under the circumstances.
  3. Subscription Fee refunds approved under clause 5(b) will be provided in the proportional amount that remains unused by the Member, processed within 10 business days of approval.
  4. For Help Wanted Ad response fees, prepaid credit packages, and other non-subscription charges, MAME CREATIVE PTY LTD will refund the fee charged where:
    1. the response or service paid for was not delivered due to a platform fault;
    2. MAME CREATIVE PTY LTD determines, at its absolute discretion, that a refund is reasonable in the circumstances; or
    3. required under the Australian Consumer Law.

    MAME CREATIVE PTY LTD does not guarantee that a parent will respond to, engage with, or proceed with any Help Wanted Ad response, and the absence of a response or engagement from a parent does not constitute a platform fault and does not entitle you to a refund (see also clause 10 - Help Wanted Ads, and clause 9 - Search Visibility). Unused prepaid credit balances are retained on your account and do not expire, but are forfeited on account closure unless redeemed beforehand. No refund is provided for any remaining days on a higher subscription tier following a downgrade - see clause 7 (Plan Changes: Upgrades and Downgrades), clause 7(c) in particular. Practitioners who attempt to respond to a Help Wanted Ad when a block exists will not be charged a credit for that attempt - block checks occur before any credit deduction. The reason for a blocked attempt is not disclosed to the practitioner through the platform.

  5. MAME CREATIVE PTY LTD does not offer refunds for change of mind or where the Services have been substantially delivered. Nothing in this clause limits any right you may have under the Australian Consumer Law.
  6. Refund requests should be submitted to admin@viaclara.com.au.

6. Subscription renewal and termination

  1. Your Subscription automatically renews at the end of each Subscription Period unless you cancel before the renewal date in accordance with clause 6(b). We will send you a reminder notice 7 days before each renewal date.
  2. You may cancel your Subscription at any time via the ‘Cancel Subscription’ function in your account settings. Cancellation takes effect at the end of your current billing period; you will retain access to your current tier's features until that date, and no further Subscription Fees will be charged. No pro-rata refund will be provided for any remaining days in the current billing period unless otherwise required by the Australian Consumer Law.
  3. If you are unable to use the self-service cancellation function, you may instead terminate by providing MAME CREATIVE PTY LTD with written notice to admin@viaclara.com.au. Termination by written notice takes effect on the date specified in your notice, or 30 days after the notice is given if no date is specified.
  4. This clause 6 governs voluntary cancellation only and does not entitle you to a refund under clause 5 (Refund Policy), which applies only to the circumstances set out in that clause.
  5. MAME CREATIVE PTY LTD may terminate these Terms with you, or suspend, restrict, or remove your Practitioner listing or account, where: you do not renew your Subscription at the end of the Subscription Period; MAME CREATIVE PTY LTD is required to do so by law; the provision of the Services to you is, in the reasonable opinion of MAME CREATIVE PTY LTD, no longer commercially viable; or MAME CREATIVE PTY LTD reasonably believes that you have breached these Terms, our Platform Content Policy, or an applicable law or professional standard (including AHPRA's Codes of Conduct), or that your conduct presents a risk to child safety, user safety, or the integrity of the platform.
  6. Where reasonably practicable, MAME CREATIVE PTY LTD will notify you of a suspension, restriction, or removal under clause 6(e) and the general basis for it, before or at the time it takes effect. MAME CREATIVE PTY LTD may delay that notice where it reasonably believes doing so is necessary to protect the safety of any person or to preserve the integrity of an investigation, but will in any event provide notice within 30 days of the action being taken, or on conclusion of the relevant investigation, whichever is sooner, unless prohibited by law from doing so. You may request review of a decision under clause 6(e) by contacting admin@viaclara.com.au; MAME CREATIVE PTY LTD will provide a substantive response within 30 days. A suspension, restriction, or removal under clause 6(e) does not entitle you to a refund of Subscription Fees already paid, except as required by the Australian Consumer Law, and does not affect MAME CREATIVE PTY LTD's retention of records relating to your account and conduct on the platform in accordance with the Privacy Policy and Data Retention Schedule, including for safety, dispute-resolution, and legal-discovery purposes. Nothing in this clause 6 limits your right to terminate your own account at any time under clause 6(b)–(c). See also clause 3(i).

7. Plan changes: Upgrades and downgrades

  1. You may change your subscription tier at any time via www.viaclara.com.au/pricing.
  2. Upgrades: If you upgrade from Pay As You Go to Pro, or from Pro to Business Builder, the new tier takes effect immediately. Your new Subscription Fee will apply from your next billing date. No additional charge is made at the time of upgrade for the remainder of your current billing period.
  3. Downgrades: A downgrade occurs either when you move from Business Builder to Pro, or when your Subscription ends - whether by cancellation under clause 6(b)–(c) or otherwise - and your account reverts to Pay As You Go. A scheduled downgrade from Business Builder to Pro takes effect at the end of your current billing period; you will retain access to your current tier's features until that date, after which the features specific to your higher tier will no longer be available. No refund is provided for the remaining days on your current plan. MAME CREATIVE PTY LTD will notify you of a scheduled change date via your account dashboard.
  4. On a downgrade, the following applies to your data and content, to the extent relevant to the downgrade that has occurred:
    1. Full profile fields (including video introduction, social media links, additional experience, qualifications, memberships, and languages): hidden from your public profile on downgrade from Pro, but retained in ViaClara's database and restored immediately if you re-upgrade.
    2. Direct messaging: on downgrade from Pro to Pay As You Go, you cannot initiate a new conversation with a parent you have not previously engaged with, and existing message threads with parents become read-only - except where you have an active or historical Help Wanted Ad response linking you to that parent, in which case you may continue messaging them, and may also start a new conversation with them, on the same basis as before the downgrade. Message history is not deleted in any case, and full messaging access is restored immediately if you re-upgrade to Pro or Business Builder.
    3. Peer networking and practitioner-to-practitioner messaging (Business Builder Plan only): existing peer conversation threads become read-only on downgrade. No new connections or messages. Connection history is retained.
    4. Calendly intro call booking: hidden from your public profile on downgrade from Business Builder. Your Calendly connection details are retained and restored if you re-upgrade.
    5. Resources Hub articles: published articles remain live on downgrade from Business Builder. Draft articles remain accessible but cannot be submitted for review. New article submissions are blocked until you re-upgrade.
    6. AI visibility analytics: the analytics dashboard card is hidden on downgrade from Business Builder. Underlying data continues to accumulate and is accessible again if you re-upgrade.
    7. Help Wanted Ad responses: on downgrade from Business Builder, responses revert to the credit-based model. Any unused prepaid credits are retained on your account.
  5. Your Neuroaffirming Verification Badge and any patient-confirmed verification status you have earned are not affected by a plan downgrade.
  6. If you delete your account while holding a positive prepaid credit balance, those credits will be forfeited and cannot be refunded. You will be asked to acknowledge this before your account deletion is confirmed.

8. Engaging with Parent Users

  1. Parent Users are independent third parties seeking allied health support. They are not vetted, employed, or supervised by MAME CREATIVE PTY LTD.
  2. MAME CREATIVE PTY LTD does not verify the accuracy of information provided by Parent Users, including the content of Help Wanted Ads, and accepts no responsibility for the accuracy of that information.
  3. Any engagement you enter into with a Parent User, and the services you provide as a result, are matters between you and that Parent User. MAME CREATIVE PTY LTD is not a party to that engagement and accepts no liability arising from it.

9. Search visibility

  1. Your position within a given set of exact-match search results is not affected by your subscription plan tier. It is determined by factors such as your current availability status; profile completeness (for example, whether you have listed a bio, areas of expertise, and populations served); how closely your profile matches the filters a parent has applied (such as expertise, age group, delivery mode, or language); proximity to the searching parent's location; and your Neuroaffirming Verification Badge status (see clause 12 - available at any level regardless of account tier). These factors apply equally regardless of plan. Subscription plan tier does determine whether certain profile fields exist on your profile at all: languages spoken is a Pro Plan/Business Builder Plan feature (see clause 7(d)(i)) and is not part of a Pay As You Go profile. Because parents can filter search results by language(s) spoken, a Pay As You Go practitioner will not appear in an exact-match search filtered by language, regardless of which languages they in fact speak - although they may still be shown as a suggested practitioner (for example, if they offer telehealth) where a search returns no exact matches. Keeping your profile complete and your availability current will generally improve your visibility within the searches you are eligible to appear in. See clause 3(k) for your obligations regarding the accuracy of your availability status, and how that status and its staleness are displayed to Parent Users. MAME CREATIVE PTY LTD may update these ranking factors, and may make additional profile fields or search filters plan-tier-specific, from time to time; any such change will be reflected in this clause and at www.viaclara.com.au/pricing.

10. Help wanted ads

  1. Help Wanted Ads allow you to respond to specific requests posted by Parent Users. Response fees apply as set out in clause 2 (Practitioner Account Tiers) and at www.viaclara.com.au/pricing.
  2. By responding to a Help Wanted Ad, you acknowledge that:
    1. payment of a response fee gives you the ability to respond to that ad - it does not guarantee that the parent will read, reply to, or engage with your response (see also clause 5(d) regarding refunds);
    2. you remain subject to the same AHPRA advertising and content standards in your response as on your profile; and
    3. MAME CREATIVE PTY LTD does not vet, verify, or take responsibility for the accuracy of Help Wanted Ad content posted by Parent Users.
  3. If a block exists between you and a Parent User in either direction, you will be unable to respond to that parent's Help Wanted Ad. Depending on the direction of the block, the ad may not appear in your listings at all, or the response function may be unavailable. No credit will be charged for a blocked response attempt.
  4. Ad Availability and Time Limits. Help Wanted Ads are not available indefinitely. A Parent User's ad is automatically removed from practitioner-facing search and browsing 45 days after it is posted, or 45 days after it is last renewed for an ad the Parent User has chosen to renew (renewal is available to a Parent User up to twice). A Parent User may also remove their ad, or mark it inactive so it is temporarily hidden from practitioners, at any time before then - marking an ad inactive does not pause or extend this 45-day period. Once an ad is no longer available to you for any of these reasons, you will not be able to view its original content on the platform.
  5. Payment of a response fee under clause 10(a) is for the ability to respond to the ad at the time you do so. It is not conditional on the ad remaining available, or on the Parent User's continued engagement with your response, afterward - see also clause 5(d) (Refund Policy) and clause 10(b)(i). MAME CREATIVE PTY LTD retains a record of your response - including a summary of the ad you responded to and the Parent User's identity - for the period set out in the Data Retention Schedule, and you will continue to be able to message and follow up with that Parent User for that period, even after the original ad is no longer available to view.

11. AHPRA advertising compliance

  1. As a registered health practitioner, you are solely responsible for ensuring that your ViaClara profile, all content you publish, and all communications you send via the platform (including Help Wanted Ad responses) comply with AHPRA's Guidelines for Advertising Regulated Health Services (as amended from time to time).
  2. Without limiting clause 10(a), you must not:
    1. include testimonials or endorsements from patients or former patients in your profile or any platform content;
    2. make claims that guarantee specific outcomes or imply a particular result from your services;
    3. use qualifications, titles, or registration statuses you are not entitled to use; or
    4. include information in your profile or content that is false, misleading, or deceptive in contravention of the Australian Consumer Law or AHPRA guidelines.
  3. MAME CREATIVE PTY LTD reserves the right to remove or require amendment of any content that, in its reasonable opinion, does not comply with AHPRA's advertising guidelines, without notice and without liability to you.
  4. If you use AI tools to generate or assist in drafting your ViaClara profile content, you remain solely responsible for ensuring that content is accurate, not misleading, and complies with AHPRA's Advertising Guidelines.

12. Neuroaffirming verification badge

  1. ViaClara's Neuroaffirming Verification Badge currently reflects one of two verification levels: self-attested (practitioner declaration only) or patient-confirmed (confirmed by families you have exchanged messages with on the platform, based on criteria determined by MAME CREATIVE PTY LTD from time to time). Both levels are available to practitioners on any account tier - your account tier does not affect your eligibility to pursue or hold either level. MAME CREATIVE PTY LTD may introduce additional verification levels (including peer-confirmation by other practitioners) in the future; if introduced, this clause will be updated to describe how that level is obtained and whether account tier affects eligibility.
  2. The Neuroaffirming Verification Badge does not constitute an endorsement by MAME CREATIVE PTY LTD, any professional body, or AHPRA, and does not guarantee that you will deliver neuroaffirming care in any particular engagement.
  3. Your badge may be represented differently to AI systems via ViaClara's API than on your profile page - see clause 15(c) (API and AI Visibility).
  4. For more information on how verification works, see www.viaclara.com.au/faq#for-practitioners.
  5. Non-Transferability. Your Neuroaffirming Verification Badge and verification status are specific to your Practitioner Account and are not transferable to a new or different account, including an account you create after deleting a previous account. A new account begins at self-attested status regardless of any verification status previously held on a prior account. MAME CREATIVE PTY LTD may, at its discretion, take into account verification history from a previous account you have satisfactorily identified as your own, but is under no obligation to do so.

13. Messaging service

  1. Parent-to-Practitioner Messaging:
    1. ViaClara's direct messaging feature is provided for the purpose of initial contact and connection with Parent Users.
    2. MAME CREATIVE PTY LTD does not monitor, endorse, or take responsibility for the content of messages exchanged between users.
    3. MAME CREATIVE PTY LTD expressly disclaims any liability for: healthcare advice given via the messaging system; agreements or arrangements made via the messaging system; or harm arising from reliance on messaging content.
    4. Messaging with Parent Users is intended to help you arrange an initial conversation, consultation, or appointment. You must not request or store Medicare numbers, diagnostic reports, or medical records via this messaging service. Where a clinical conversation is appropriate, this should occur directly with the family through your own secure, professional channels once a consultation has been arranged.
    5. Practitioners on the Pay As You Go plan can respond to messages from, and continue conversations with, any parent - including initiating a new conversation with a parent to whom you have responded via a Help Wanted Ad. Initiating a new conversation with a parent through any other means is a Pro Plan/Business Builder Plan feature; see clause 7(d)(ii) for what happens to this on downgrade.
  2. Peer Networking and Practitioner-to-Practitioner Messaging (Business Builder Plan):
    1. ViaClara's peer networking and practitioner-to-practitioner messaging features are provided for professional networking purposes only.
    2. You must not share identifiable client information via these features without the client's express consent.
    3. You are solely responsible for ensuring that your use of these features complies with your professional obligations, including obligations of confidentiality under your professional registration and AHPRA's Code of Conduct.
    4. MAME CREATIVE PTY LTD expressly disclaims any liability for the content of practitioner-to-practitioner communications, and does not monitor peer messages except where required to investigate a reported breach of these Terms or applicable law.
  3. Blocking:
    1. You may block another user you have previously interacted with. Blocking prevents the blocked user from sending you messages, starting new conversations with you, responding to your Help Wanted Ads, and viewing your contact details on your profile. Blocking takes effect immediately and is enforced at the server level - it cannot be circumvented through the platform interface.
    2. When a block exists, existing message history remains visible to both parties in read-only mode. Neither party can send new messages to the other.
    3. Block records are retained permanently, including if you later unblock a user or delete your account. Block history is preserved for safety and legal purposes.
    4. A block can only be reversed by the user who created it. MAME CREATIVE PTY LTD does not unblock users on behalf of either party.
    5. If you have an active or pending engagement with a user, you should communicate directly with them before blocking, as MAME CREATIVE PTY LTD is not responsible for the consequences of a blocked communication on any arrangement between you and that user.
    6. If you have a pending peer connection request with another Practitioner User (Business Builder Plan) at the time a block is created or reinstated between you, that request is automatically declined. Neither party is notified as a result of this automatic decline, consistent with how a manually declined connection request is handled. This clause does not apply to Parent Users, as peer connection requests exist only between Practitioner Users.

14. Professional indemnity insurance

  1. You warrant that you hold, and will maintain throughout your registration with ViaClara, current and adequate professional indemnity insurance covering your allied health practice and any services you provide to clients met through ViaClara.
  2. ViaClara's platform subscription does not provide or substitute for professional indemnity insurance.
  3. You agree to provide evidence of current professional indemnity insurance to MAME CREATIVE PTY LTD upon request. Failure to maintain adequate insurance may result in suspension or termination of your Account.
  4. Retention of Insurance Evidence. Evidence of professional indemnity insurance you provide under clause 14(c), and any related confirmation held on your account, is retained in accordance with our Data Retention Schedule.

15. API and AI visibility

  1. ViaClara's API makes a fixed set of practitioner profile fields available to third-party AI systems for the purpose of improving your discoverability to families seeking allied health support. The API is available to Pro Plan and Business Builder Plan subscribers only. By subscribing to either plan, you consent to this disclosure. See clause 15(d) for how to withdraw this consent.
  2. The fields exposed via the API are determined by MAME CREATIVE PTY LTD, not by you, and are the same for all approved practitioners on an eligible plan. You cannot select or deselect individual fields for inclusion. The API is designed to exclude sensitive and operational data by default, including (without limitation) your email address, phone number, exact location coordinates, external website and social media links, video introduction, internal platform identifiers, engagement and interaction data, and any messaging, conversation, or notification data. A current description of what the API exposes is available at viaclara.com.au/for-ai.
  3. Your neuroaffirming verification status may be represented differently via the API than on your ViaClara profile page. Self-attested verification is not displayed via the API; only family-confirmed verification is shown, using standard descriptive wording set by MAME CREATIVE PTY LTD rather than the raw verification label.
  4. You may withdraw your consent to API visibility in either of two independent ways. First, you may turn off the AI Visibility control in your account settings while remaining on your current plan - this stops your profile being returned by the API from that point on, and does not change your subscription fee or plan tier. You may turn AI Visibility back on at any time while subscribed to the Pro Plan or Business Builder Plan. Second, you may withdraw consent entirely by downgrading to the Pay As You Go plan, at which point your profile will no longer be returned by the API, along with the other Pro Plan/Business Builder Plan benefits that are lost on downgrade. Turning off the AI Visibility control does not retroactively remove any copy of your profile data that a third-party AI system already retrieved via the API before you turned it off - see clause 15(e).
  5. The ViaClara API does not require authentication and may be accessed by any third-party AI system, including but not limited to AI assistants and search tools not affiliated with or vetted by MAME CREATIVE PTY LTD. MAME CREATIVE PTY LTD does not control, and is not responsible for, how a third-party AI system uses, presents, summarises, or stores data obtained from the API.
  6. MAME CREATIVE PTY LTD logs API requests, including how often your profile was retrieved, for the purposes of platform security, rate limiting, internal admin reporting on AI agent traffic and platform performance, and (where applicable to your plan) AI visibility analytics as described in the Privacy Policy.

16. Resources Hub (Business Builder Plan)

  1. You retain all copyright and other intellectual property rights in content you publish to ViaClara's Resources Hub. By publishing content, you grant MAME CREATIVE PTY LTD a non-exclusive, royalty-free, worldwide licence to display, distribute, and moderate that content on the platform.
  2. You warrant that published content: is accurate and not misleading or deceptive; complies with AHPRA's Guidelines for Advertising Regulated Health Services; does not constitute individual healthcare advice directed at a specific person; does not infringe any third-party intellectual property rights; and complies with ViaClara's Platform Content Policy.
  3. MAME CREATIVE PTY LTD reserves the right to remove non-compliant Resources Hub content without notice. A general disclaimer is displayed automatically on all Resources Hub articles confirming that content is general in nature and reflects the views of the individual author, not MAME CREATIVE PTY LTD.
  4. Editing Published Articles. You may edit an article you have published at any time via your dashboard. Minor edits (no change to title or excerpt, and a body change of 5% or less) remain live while reviewed. Substantive edits (a change to title or excerpt, or a body change of more than 5%) are temporarily hidden from public view until reviewed; if a substantive edit is not approved, your article is restored to its last approved version. MAME CREATIVE PTY LTD may make minor corrections (such as typo or formatting fixes) to your published article without your prior consent, and will notify you when this occurs.
  5. Deleting Published Articles. You may remove an article you have submitted from public view at any time via your dashboard. If MAME CREATIVE PTY LTD has published an article on your behalf that you did not submit yourself, you may request its removal, which MAME CREATIVE PTY LTD will review; this is not an automatic right of deletion for content you did not author.
  6. Articles on Account Deletion or Removal. If you delete your ViaClara account, or if your account is suspended or removed under clause 6(e), your previously published articles are removed from public view. Article content is not permanently destroyed at that time - see our Data Retention Schedule for the applicable retention period, which differs depending on the circumstances of your account's closure.

17. Third party service integrations

  1. ViaClara integrates with third-party services including, but not limited to, appointment booking platforms (Business Builder Plan). By enabling a third-party integration, you acknowledge that: your data (including appointment information) will be processed by the third-party service subject to that provider's own privacy policy and terms of service; MAME CREATIVE PTY LTD is not responsible for the data handling practices of third-party service providers; and you should review the relevant third-party terms before enabling the integration.

18. Data security obligations

  1. If your use of the Services involves storing, accessing, or processing any ViaClara user data on your own devices, accounts, or practice management systems - including a Parent User's contact details, a child's support-need information, appointment notes, or message content you have exported or transcribed - you must take reasonable steps to protect that data against unauthorised access, loss, misuse, or disclosure, having regard to its sensitivity.
  2. If you become aware of an actual or suspected security incident involving ViaClara user data on your own systems (including a lost or stolen device, unauthorised account access, or a ransomware or malware event), you must:
    1. notify MAME CREATIVE PTY LTD at privacy@viaclara.com.au within 24 hours of becoming aware of the incident;
    2. provide MAME CREATIVE PTY LTD with sufficient information to assess whether the incident may constitute an eligible data breach under the Notifiable Data Breach Scheme (Privacy Act 1988 (Cth) Part IIIC), including the nature of the data involved, the number of individuals affected (so far as known), and the cause of the incident; and
    3. cooperate with MAME CREATIVE PTY LTD's investigation of the incident and comply with any reasonable direction from MAME CREATIVE PTY LTD regarding notification of affected users, pending the outcome of that investigation.
  3. Nothing in this clause 18 substitutes for, or discharges, any independent obligation you may have as an APP entity under the Privacy Act 1988 (Cth) or any other applicable law. If you are independently required to notify affected individuals or a regulator, you must do so in your own right; MAME CREATIVE PTY LTD's notification of an incident on your behalf, or its involvement in assessing an incident, does not relieve you of that independent obligation.
  4. MAME CREATIVE PTY LTD's Data Breach Policy sets out ViaClara's own response process for incidents involving ViaClara user data, including incidents notified under this clause 18. That Policy does not form part of these Terms but describes how MAME CREATIVE PTY LTD will act on information provided under sub-clause (b).

19. Account deletion

  1. You may delete your Practitioner Account at any time via your account settings, or by contacting admin@viaclara.com.au if you are unable to do so.
  2. On deletion, your public profile and search listing are removed immediately. Any positive prepaid credit balance is forfeited and cannot be refunded (see clause 7(f)).
  3. Message history, block records, and other information may be retained after deletion in accordance with our Privacy Policy and Data Retention Schedule, including for legal, safety, or dispute-resolution purposes.

20. Data export

  1. ViaClara provides a self-service Data Export function in your account settings, allowing you to download a copy of certain personal information ViaClara holds about you in a machine-readable format. See Privacy Policy clause 11.6 for the current scope of what is included.
  2. Your export includes your block history - for each user you have blocked, the date you blocked them and your current status (active or, if you have since unblocked them, the date you did so). Consistent with clause 13(c), your export reflects only blocks you have made. It does not, and will never, disclose whether another user has blocked you.
  3. Some categories of information are not included in the self-service export and remain available only on request - see Privacy Policy clause 11.1 (Access).

21. Reporting

  1. ViaClara provides an in-app reporting feature. You can report a Parent User, another Practitioner User, a message (including an individual message within a conversation or a peer message), a Help Wanted Ad, or content that you believe breaches the Platform Content Policy or these Terms, using the “Report” control available within a message thread, on a Help Wanted Ad you are viewing or have responded to, or elsewhere as made available on the platform from time to time.
  2. When you submit a report, MAME CREATIVE PTY LTD creates a record of your report, together with a point-in-time copy of the reported content, for the purpose of reviewing and, where appropriate, acting on it. See the Privacy Policy and our Data Retention Schedule for what information is collected and how long it is retained.
  3. You may submit a report together with blocking the reported user, or a report on its own. Blocking takes effect immediately in accordance with clause 13(c) and is not conditional on the outcome of any report.
  4. MAME CREATIVE PTY LTD reviews every report. We will send you an acknowledgement when you submit a report, and a general outcome notification once a decision is made. Consistent with our approach to reporter anonymity, we do not disclose to you the specific action, if any, taken against the reported party. See the Platform Content Policy, clause 7, for further detail on how reports are reviewed and actioned.
  5. MAME CREATIVE PTY LTD also uses automated scanning, and periodic profile review, to proactively identify content that may breach the Platform Content Policy, including on your profile, messages, Help Wanted Ad responses, and Resources Hub article edits. See the Platform Content Policy, clauses 7.1 and 7.4, for further detail.
  6. You can also make a complaint directly to the eSafety Commissioner (esafety.gov.au) at any time, independently of ViaClara's own reporting process.
  7. Submitting a report that you know to be false, or that is made in bad faith, is itself a breach of the Platform Content Policy and these Terms, and may be considered under clause 6(e).

22. Referral program

  1. How the program works. MAME CREATIVE PTY LTD operates an optional Referral Program that allows approved Practitioner Users to earn rewards by referring colleagues to apply to join ViaClara. When a practitioner you have referred is approved onto the platform, you earn a referral reward and they earn a welcome reward, each as described in sub-clause (c) below. No reward is earned merely by a referred person applying - approval is required. This reward is for referring a fellow practitioner to apply to join the ViaClara platform. It is not, and must not be treated as, an inducement or reward for referring a patient, client, or their family to another practitioner or provider, and must not be represented as such in any communication you send inviting a colleague to join.
  2. Eligibility. To participate in the Referral Program:
    • You must hold an approved Practitioner Account on ViaClara at the time the referred practitioner is approved. If your account is removed for cause between the date of referral and the date of approval, your referral will be voided and no reward will be granted - see sub-clause (f).
    • You cannot refer yourself. A referral code used to register an account that shares your user identity is automatically invalid.
    • The referral code is personal to you. It may not be sold, exchanged, or transferred to another person or entity.
    • The Referral Program is available to practitioners on all account tiers (Pay As You Go, Pro, and Business Builder).
  3. Rewards. Reward values and types are set out at www.viaclara.com.au/practitioner/dashboard/referrals and may be updated from time to time with notice to you under sub-clause (h). Rewards are applied to your account as credits or account balance adjustments as described at www.viaclara.com.au/practitioner/dashboard/referrals. Rewards are not redeemable for cash and are not transferable to another person or account.
  4. Credit conversion on upgrade. If you earn a Help Wanted Ad response credit under sub-clause (c) while on the Pay As You Go or Pro plan, and you subsequently upgrade to the Business Builder plan before that credit is spent, ViaClara will automatically convert that unspent referral credit into an equivalent account credit and apply it to your next invoice. This conversion is one-directional - a later downgrade from the Business Builder plan does not reverse a conversion that has already occurred.
  5. Referral code regeneration. You may generate a new referral code at any time via your practitioner dashboard. Doing so immediately invalidates your previous code - any person who attempts to use the old code after regeneration will find it invalid. Referrals already recorded using your old code (where the referred practitioner's application is still pending approval) are not affected - those referrals are tracked by the code that was used at the time of registration, not the code you currently hold.
  6. Void and forfeiture. A pending referral (one where the referred practitioner has not yet been approved) will be voided, and no reward will be granted, in any of the following circumstances: your account is removed for cause under clause 6(e) before the referred practitioner is approved; the referred practitioner's application is not approved within 90 days of their last activity on the application - in which case the referral is treated as abandoned, and no further reward will be granted even if the same person later reapplies; or MAME CREATIVE PTY LTD determines, in its reasonable discretion, that the referral was made fraudulently, in breach of these Terms, or in a manner that abuses the Referral Program (including without limitation by creating multiple accounts, by referring a person who has previously been removed from the platform, or by any attempt to manufacture or game referrals); or MAME CREATIVE PTY LTD discontinues the Referral Program under sub-clause (h). A reward that has already been granted is not reversed except where MAME CREATIVE PTY LTD determines that the reward was obtained by fraud or a material misrepresentation, in which case MAME CREATIVE PTY LTD may reverse the reward by an equivalent deduction from your account balance or credits. Where reasonably practicable, MAME CREATIVE PTY LTD will notify you of a void or reversal under this sub-clause (f) and the general basis for it. You may request review of a decision under this sub-clause (f) by contacting admin@viaclara.com.au; MAME CREATIVE PTY LTD will provide a substantive response within 30 days. Nothing in this sub-clause (f) affects any right you may have under the Australian Consumer Law.
  7. Tax. Referral rewards (whether in the form of a Help Wanted Ad response credit or an account credit) may constitute assessable income for Australian income tax purposes depending on your individual circumstances. MAME CREATIVE PTY LTD does not provide tax advice, and any reward earned through the Referral Program is earned at your own risk as to its tax treatment. You are solely responsible for complying with your own tax obligations in relation to referral rewards you receive. We recommend consulting a registered tax adviser if you are uncertain whether a reward is assessable.
  8. Program changes and discontinuation. MAME CREATIVE PTY LTD may modify or discontinue the Referral Program at any time on reasonable notice to you. On discontinuation: pending referrals (where the referred practitioner has not yet been approved) will be cancelled with no reward; referrals already rewarded are not reversed. MAME CREATIVE PTY LTD will endeavour to provide at least 30 days' notice before discontinuing the program entirely.

Parent terms (v2.5)

1. How these terms apply

  1. These Parent Terms apply to you if you register for or use a Free User Account on ViaClara. They apply in addition to ViaClara's Platform Terms, available at www.viaclara.com.au/terms#platform-terms. By using ViaClara as a Parent User, you accept both documents.
  2. If there is any inconsistency between these Parent Terms and the Platform Terms, these Parent Terms prevail in respect of the matters they specifically address.

2. Your account

  1. ViaClara offers a Free User Account for individuals searching for allied health services for their child. There is no fee to register for or use a Free User Account.
  2. As part of registration, or as part of your continued use of the Services, you may be required to provide personal information, including but not limited to your name, email address, phone number, and information about your child's support needs. You warrant that any information you provide will always be accurate, correct and up to date.
  3. You may not use the Services if: you are not of legal age to form a binding contract with MAME CREATIVE PTY LTD; or you are a person barred from receiving the Services under the laws of Australia or other applicable countries.
  4. At sign-up, you will be asked whether you would like to join ViaClara's marketing mailing list. This is optional and is not a condition of creating or using your Account. See the Privacy Policy, Section 4.3, for how your marketing preferences are used and how to withdraw your consent, and Platform Terms clause 7(b) for the corresponding Spam Act 2003 (Cth) undertaking.

3. Account deletion

  1. You may delete your Free User Account at any time via your account settings, or by contacting admin@viaclara.com.au.
  2. On deletion, your profile and search history will be removed in accordance with our Privacy Policy and Data Retention Schedule. Message history may be retained for the period set out in our Data Retention Schedule even after account deletion, where retention is necessary for legal, safety, or dispute resolution purposes.
  3. MAME CREATIVE PTY LTD may suspend or close your account where: you breach these Terms, the Platform Terms, or the Platform Content Policy; MAME CREATIVE PTY LTD is required to do so by law; or MAME CREATIVE PTY LTD reasonably believes your conduct presents a risk to the safety of another user (including a child) or to the integrity of the platform.
  4. Where reasonably practicable, MAME CREATIVE PTY LTD will notify you of a suspension or closure under clause 3(c) and the general basis for it, before or at the time it takes effect. MAME CREATIVE PTY LTD may delay that notice where it reasonably believes doing so is necessary to protect the safety of any person or to preserve the integrity of an investigation, but will in any event provide notice within 30 days of the action being taken, or on conclusion of the relevant investigation, whichever is sooner, unless prohibited by law from doing so. You may request review of a decision under clause 3(c) by contacting admin@viaclara.com.au; MAME CREATIVE PTY LTD will provide a substantive response within 30 days. Suspension or closure under clause 3(c) does not affect MAME CREATIVE PTY LTD's retention of records relating to your account in accordance with the Privacy Policy and Data Retention Schedule, including for safety, dispute-resolution, and legal-discovery purposes.

4. Engaging third party practitioners

  1. Practitioners listed on ViaClara are independent allied health professionals. They are not employees, agents, or contractors of MAME CREATIVE PTY LTD. MAME CREATIVE PTY LTD does not employ, supervise, or direct the clinical practice of any practitioner listed on the platform.
  2. MAME CREATIVE PTY LTD checks each practitioner's professional registration or membership number against a relevant public register at the time of approval, where one exists. The register checked, and the confidence you can place in that check, varies by profession:
    1. For Occupational Therapists, Psychologists, Psychiatrists, Paediatricians, and Physiotherapists, we check the AHPRA public register. This is the highest-confidence check available, as AHPRA registers are independently maintained and updated in real time.
    2. For Speech Pathologists, Counsellors, and Art Therapists, we check the relevant professional body's public register (Speech Pathology Australia, ARCAP, or ANZACATA). These bodies actively certify the practitioners on their registers.
    3. For Dietitians and Music Therapists, we check the relevant association's public directory (Dietitians Australia or AMTA). These directories are maintained on a self-reported basis and are not independently audited by the association for accuracy, and in AMTA's case may not be complete. Where displayed on a practitioner's profile, we include a specific notice about this limitation next to the credential.
    4. For Nutritionists and Equine-assisted Therapists, no single Australian registration body exists. Where a practitioner in one of these categories holds an underlying allied health or mental health registration (for example, AHPRA or ARCAP), we check that underlying registration instead, and it carries the corresponding confidence level under sub-clause (i) or (ii) above. Otherwise, any qualification or training the practitioner discloses is self-reported and not independently verified by MAME CREATIVE PTY LTD.
  3. Where a practitioner's registration or membership number is displayed on their profile, this is to allow you to independently verify it yourself against the relevant public register - we encourage you to do this before engaging any practitioner, particularly for services involving your child. For AHPRA-regulated professions, you can check registration directly at www.ahpra.gov.au. Where a credential is shown with a caveat notice (see sub-clause (b)(iii)–(iv) above), that notice reflects a genuine limitation in what MAME CREATIVE PTY LTD is able to verify for that profession. It does not necessarily mean the practitioner is unqualified - it means we are not able to confirm their credentials to the same standard as an AHPRA-regulated practitioner, and you should factor that into your own decision-making.
  4. Each practitioner's Australian Business Number (ABN) is also displayed on their profile. This confirms the practitioner's registered business identity and allows you to look up their business details on the public ABN Lookup register (abr.business.gov.au) - for example, to confirm the legal entity you would be contracting with if you engage that practitioner directly. Display of a practitioner's ABN is not a form of clinical or professional credential verification, and is separate from the registration checks described in sub-clause (b).
  5. Timing of Verification. The registration and membership checks described in sub-clause (b) are performed at the time a practitioner is approved to join ViaClara. They are not repeated automatically on an ongoing basis, and a practitioner's registration status may change after approval without this being immediately reflected on ViaClara. We encourage you to check a practitioner's current registration status directly against the relevant public register (see sub-clause (c)) at the time you engage them - particularly where your engagement begins some time after you first found the practitioner, or continues over an extended period.
  6. MAME CREATIVE PTY LTD requires practitioners to self-attest that they hold a current Working With Children Check (or equivalent state/territory clearance) as a condition of registration (see Practitioner Terms clause 3(h)), but does not itself conduct, verify, or warrant that any practitioner holds such a clearance. You should verify this independently - for example, by asking to see the practitioner's current clearance - before engaging any practitioner for an in-person, unsupervised service involving your child.
  7. Nothing on ViaClara constitutes professional healthcare advice. Any decision to engage a practitioner is made at your own risk.
  8. MAME CREATIVE PTY LTD expressly excludes liability for any harm, loss, or damage arising from your engagement with, or the services provided by, any practitioner discovered through ViaClara's platform, including through AI-assisted search and discovery features.
  9. Availability Status. Each practitioner's profile and search result card displays an availability status (for example, Available Now, Filling Soon, Waitlist, or Not Accepting New Clients). This status is set and updated by the practitioner themselves via their own dashboard. It is not verified, checked, or audited by MAME CREATIVE PTY LTD in any way, and MAME CREATIVE PTY LTD does not warrant that a displayed status accurately reflects a practitioner's actual current capacity to accept new clients. Keeping this status accurate, and not deliberately misrepresenting their availability, is solely the practitioner's own responsibility (see Practitioner Terms clause 3(k)) - a practitioner who simply hasn't updated their status recently has not necessarily done anything wrong, but this is reflected to you via the staleness indicator described below.
  10. If a practitioner has not updated their availability status within the preceding two weeks, ViaClara displays that status with a visual indicator (a red outline) showing it may be out of date, together with the approximate time since it was last updated. The absence of this indicator means only that the status was updated within the last two weeks - it is not confirmation from MAME CREATIVE PTY LTD that the status is accurate. You should treat any availability status, whether or not flagged as potentially out of date, as an indication only, and confirm current availability directly with the practitioner before making any decision based on it - particularly where timing matters to your child's needs.
  11. If you believe a practitioner is deliberately misrepresenting their availability, or any other aspect of their profile, you can let us know via our contact page at www.viaclara.com.au/contact.

5. Search results

  1. Search results on ViaClara are ordered to help you find a suitable practitioner. Ranking takes into account factors such as: practitioner availability; profile completeness (for example, whether a bio, areas of expertise, and populations served are listed); how closely a practitioner's profile matches search filters you have applied (such as expertise, age group, delivery mode, or language); proximity to your location; and a practitioner's Neuroaffirming Verification Badge status. See clause 4(i) for what a practitioner's availability status represents, how it is set and displayed, and MAME CREATIVE PTY LTD's role - or lack of one - in verifying its accuracy. These factors apply on the same basis to every practitioner regardless of subscription plan, with one exception: filtering by language(s) spoken relies on profile information that is only collected on Pro Plan and Business Builder Plan profiles (see Practitioner Terms cl.7(d)(i)) - a Pay As You Go practitioner's profile does not include this field, so they will not appear in a search using this specific filter, regardless of the languages they actually speak. Where a search returns no exact matches near you, ViaClara may show suggested practitioners - for example, practitioners offering telehealth - who do not meet every filter you applied; these are clearly labelled as suggestions rather than exact matches. ViaClara may update these ranking factors from time to time to improve relevance, and if any additional search filter or verification pathway is limited to particular plan tiers in future, that will be disclosed here and at www.viaclara.com.au/pricing.
  2. Some search results may be generated with the assistance of AI-powered tools. These results are not personal recommendations and do not constitute an endorsement by MAME CREATIVE PTY LTD of any specific practitioner. See clause 4 above regarding engaging practitioners found through ViaClara.

6. Help wanted ads

  1. You may post a Help Wanted Ad describing the allied health support you are seeking. A Help Wanted Ad may include: your child's age range, the type of support sought (described by challenge area, such as communication or daily living skills, rather than diagnosis), the type of practitioner you are seeking, an ad title and description, your suburb, availability details, preferred mode of delivery, urgency, NDIS registration requirements, and language requirements.
  2. Your child's name or nickname, if you choose to provide one, is used only to help you identify and select the correct child profile within your own account - for example, if you have more than one child registered on ViaClara. It is not displayed to practitioners at any point, whether via a Help Wanted Ad or elsewhere on the platform, unless you choose to share it yourself, such as in a direct message.
  3. In the free-text description field, we recommend describing your child's support needs by challenge area (such as communication, daily living skills, or sensory processing) rather than including diagnostic or clinical information. This field is shown in full to any practitioner browsing Help Wanted Ads, whether or not they respond to your ad. Information you choose to include in this field is your choice, and is included at your own risk - see clause 7(d) below regarding messaging and the sharing of health information generally.
  4. By posting a Help Wanted Ad, you consent to your ad being visible to practitioners on the platform and to receiving responses from practitioners who choose to respond. MAME CREATIVE PTY LTD does not guarantee that any practitioner will respond to your Help Wanted Ad, that responses will be suitable for your needs, or that a minimum number of responses will be received. ViaClara's Platform Content Policy applies to all Help Wanted Ad content.
  5. If you have blocked a practitioner, that practitioner will be unable to respond to your Help Wanted Ads. Your ad may not appear in their listings at all, depending on the direction of the block.
  6. Ad Duration, Archiving, and Removal. A Help Wanted Ad you post is automatically removed from practitioner search and browsing 45 days after posting, unless you renew it before then - renewal is available up to twice, extending your ad's visibility to practitioners by a further 45 days each time. You may also remove your ad yourself, or mark it inactive so it is temporarily hidden from practitioners, at any time. Marking an ad inactive does not pause or extend the 45-day period described above - an inactive ad continues counting down toward the same time limit as an active one. Once your ad is no longer shown to practitioners, for any of these reasons, it is not visible to any practitioner on the platform, regardless of whether they have already responded to it.
  7. If your ad reaches its time limit without being renewed further, we keep a full copy of it - visible only to you, in the “Expired” section of your Help Wanted Ads dashboard - for 180 days. This lets you review it, understand why it may not have received the responses you were hoping for, or use it as the starting point for a new ad. This copy is never shown to any practitioner. If you remove your ad yourself before it reaches its time limit, this archive copy is not created, and your ad is deleted immediately instead.
  8. At the end of the 180-day archive period, or immediately if you remove your ad yourself, MAME CREATIVE PTY LTD permanently deletes the individual ad record. Before deletion, we extract anonymous, aggregated statistics from it - such as the general type of support sought, broad location, and number of responses received - with no information capable of identifying you or your child. These statistics may be retained indefinitely and are not personal information once de-identified. See our Privacy Policy and Data Retention Schedule for further detail.
  9. Responses you have already received to a Help Wanted Ad, and any conversation that results from a response, are not affected by your ad reaching the end of its display period, being archived, or being deleted - these continue to be available to you on their own timeline, described in clause 7 (Messaging Service) and our Data Retention Schedule.

7. Messaging service

  1. ViaClara's direct messaging feature is provided for the purpose of initial contact and connection with practitioners.
  2. MAME CREATIVE PTY LTD does not monitor, endorse, or take responsibility for the content of messages exchanged between users.
  3. MAME CREATIVE PTY LTD expressly disclaims any liability for: healthcare advice given via the messaging system; agreements or arrangements made via the messaging system; or harm arising from reliance on messaging content.
  4. Messaging on ViaClara is intended to help you arrange an initial conversation, consultation, or appointment with a practitioner. We strongly discourage sharing diagnosis details, clinical history, or other sensitive health information via the messaging service - if you choose to do so, you do so at your own risk, and MAME CREATIVE PTY LTD accepts no responsibility for the security or use of that information once shared. For sharing of clinical information, we recommend doing so directly with your practitioner through their own secure, professional channels once a consultation has been arranged.
  5. You must not share Medicare numbers, full medical records, or other highly sensitive identifying documents via the messaging service.
  6. Blocking:
    1. You may block another user you have previously interacted with. Blocking prevents the blocked user from sending you messages, starting new conversations with you, responding to your Help Wanted Ads, and viewing your contact details on your profile. Blocking takes effect immediately and is enforced at the server level - it cannot be circumvented through the platform interface.
    2. When a block exists, existing message history remains visible to both parties in read-only mode. Neither party can send new messages to the other.
    3. Block records are retained permanently, including if you later unblock a user or delete your account. Block history is preserved for safety and legal purposes.
    4. A block can only be reversed by the user who created it. MAME CREATIVE PTY LTD does not unblock users on behalf of either party.
    5. If you have an active or pending engagement with a practitioner, you should communicate directly with them before blocking, as MAME CREATIVE PTY LTD is not responsible for the consequences of a blocked communication on any arrangement between you and that practitioner.

8. Children’s information

  1. By providing information about a child on ViaClara, you confirm that: you are the parent or legal guardian of the child about whom you are providing information; and you consent to MAME CREATIVE PTY LTD collecting, using, and storing that information for the purposes described in the Privacy Policy.
  2. ViaClara does not knowingly collect personal information directly from children. If you believe a child has provided information to ViaClara without parental consent, please contact us at privacy@viaclara.com.au and we will promptly delete the relevant information.

9. Resources Hub

  1. Resources Hub articles are written by individual practitioners and reflect their own views, opinions, and clinical approach. They do not represent the views of MAME CREATIVE PTY LTD, and MAME CREATIVE PTY LTD does not endorse, verify, or take responsibility for the accuracy of Resources Hub content.
  2. Articles are general information only and are not a substitute for individualised professional advice about your child's specific needs.

10. Payments

  1. There is no fee to register for or use a Free User Account. ViaClara does not currently charge Parent Users for any feature of the Service.
  2. If this changes in the future, MAME CREATIVE PTY LTD will provide reasonable notice before introducing any fee applicable to Parent Users, and current information will be available at www.viaclara.com.au/pricing.

11. Data export

  1. ViaClara provides a self-service Data Export function in your account settings, allowing you to download a copy of certain personal information ViaClara holds about you in a machine-readable format. See Privacy Policy clause 11.6 for the current scope of what is included.
  2. Your export includes your block history - for each user you have blocked, the date you blocked them and your current status (active or, if you have since unblocked them, the date you did so). Consistent with clause 7(f), your export reflects only blocks you have made. It does not, and will never, disclose whether another user has blocked you.
  3. Some categories of information are not included in the self-service export and remain available only on request - see Privacy Policy clause 11.1 (Access).

12. Reporting

  1. ViaClara provides an in-app reporting feature. You can report a practitioner, a message (including an individual message within a conversation), a Help Wanted Ad response, or content that you believe breaches the Platform Content Policy or these Terms, using the “Report” control available on a practitioner's profile, within a message thread, or on a Help Wanted Ad response.
  2. When you submit a report, MAME CREATIVE PTY LTD creates a record of your report, together with a point-in-time copy of the reported content, for the purpose of reviewing and, where appropriate, acting on it.
